Employers should not decline to employ an individual due to evidence of illegal substances in their bodies. The case with Cheryl Hale by Wing implies that second-hand marijuana smokers are victims of positive drug tests even though they do not use the drug directly. Instead of declining drug to hire, employers should consider giving the applicants chances to explain their scenario and encounters.
